These Terms of Service (“Terms”) govern your access to and use of the Unmapped mobile application, website, backend services, data, maps, navigation features, community features, and related services (collectively, the “Services”).
The Services are operated by Unmapped Navigation LLC, doing business as Unmapped ("Unmapped," "we," "us," or "our").
By accessing or using the Services, you agree to these Terms.
If you do not agree to these Terms, do not use the Services.
1. ABOUT UNMAPPED

A feature described here may be optional, limited, experimental, or unavailable. The current product is in active development and some advertised capabilities are not yet available.
Other features may be designed to operate offline.
2. ELIGIBILITY
Unmapped is a general-audience service and does not set an additional minimum age beyond applicable law. You must be legally able to agree to these Terms, or have the permission and supervision of a parent or legal guardian where the law requires it.
If you are under the age of majority where you live, you may use the Services only with the permission and supervision required by applicable law.
You may not use the Services if applicable law prohibits you from doing so.
3. LICENSE TO USE UNMAPPED
Use of the iOS app distributed through Apple's App Store is governed by Apple's Standard End User License Agreement. Subject to that license and these Terms, you may access Unmapped's related Services for lawful personal purposes.
These Terms do not transfer ownership of Unmapped's software, branding, proprietary datasets, interfaces, designs, or other intellectual property to you.
Except where applicable law permits otherwise, you may not:
- copy or redistribute substantial portions of proprietary Unmapped content;
- reverse engineer or attempt to derive source code from proprietary portions of the Services;
- bypass security, authentication, rate limits, subscription controls, or technical restrictions;
- access the Services using automated systems in a manner that materially burdens or disrupts them;
- scrape proprietary Unmapped data for redistribution or resale;
- impersonate another person;
- interfere with other users;
- use the Services to violate applicable law or the rights of another person; or
- use Unmapped branding in a manner suggesting affiliation or endorsement without permission.
Nothing in these Terms restricts rights granted to you under applicable open-source licenses or other third-party licenses.
4. NAVIGATION REQUIRES YOUR JUDGMENT
YOUR USE OF THIS REAL TIME ROUTE GUIDANCE APPLICATION IS AT YOUR SOLE RISK. LOCATION DATA MAY NOT BE ACCURATE.
Unmapped is a navigation aid. It is not a substitute for your judgment, observation, preparation, or compliance with actual conditions and applicable law.
Maps, routes, directions, estimated travel times, road classifications, trail information, access information, points of interest, elevation data, and other geographic information can be incomplete, inaccurate, delayed, outdated, or unavailable.
A route displayed by Unmapped does not guarantee that:
- the route is physically passable;
- the route is legally open;
- your vehicle is capable of traveling it;
- the road or trail still exists;
- bridges or crossings are safe;
- gates are open;
- seasonal restrictions have ended;
- private-property access is authorized;
- weather has not made the route dangerous;
- the route is suitable for your experience level;
- emergency services can reach you; or
- cellular or satellite communication is available.
You are responsible for evaluating actual conditions.
Always obey signs, gates, closures, law-enforcement instructions, emergency instructions, land-management rules, and applicable laws even if they conflict with information displayed by Unmapped.
5. DO NOT INTERACT WITH UNMAPPED UNSAFELY WHILE DRIVING
Do not enter information, manipulate maps, read detailed content, submit reports, configure trips, or otherwise interact with Unmapped in a manner that distracts you from safely operating a vehicle.
Use available voice guidance, suitable hands-free controls, or a passenger to operate the app where lawful. A reference to a possible integration does not mean that CarPlay or another external-device feature is currently supported.
You are responsible for complying with distracted-driving and hands-free laws.
If Unmapped provides an instruction that cannot be followed safely or legally, do not follow it.
Safety and applicable law take priority over any instruction displayed or spoken by Unmapped.
6. OFF-ROAD AND REMOTE TRAVEL
Off-road driving, overlanding, hiking, camping, and remote travel can involve serious hazards.
Potential hazards include:
- difficult terrain;
- vehicle damage;
- mechanical failure;
- getting stuck or stranded;
- falls;
- wildlife;
- flooding;
- extreme temperatures;
- wildfire;
- severe weather;
- poor road conditions;
- river or water crossings;
- rockfall;
- altitude;
- lack of potable water;
- lack of cellular service;
- delayed emergency response; and
- other natural or human-created hazards.
You are responsible for determining whether an activity is appropriate for you, your vehicle, your equipment, your experience, and current conditions.
Unmapped does not guarantee your safety or the suitability of any route, road, campsite, trail, or activity.
7. ROAD ACCESS, PUBLIC LAND, AND MVUM INFORMATION
Unmapped may display information concerning:
- public lands;
- Motor Vehicle Use Maps (“MVUMs”);
- roads;
- trails;
- vehicle classifications;
- seasonal access;
- dispersed camping;
- land-management boundaries;
- private property;
- rights-of-way;
- closures; and
- other access-related information.
This information may originate from federal, state, local, tribal, public, community, commercial, or third-party sources.
A line appearing on the map does not grant you permission to travel on that road, trail, or property.
Likewise, the absence of a closure or restriction in Unmapped does not establish that access is lawful.
Official signs, regulations, orders, current agency information, property rights, permits, and applicable law control.
You are responsible for confirming legal access before entering a road, trail, campsite, or property. Where Unmapped displays MVUM or similar authoritative information, the original official publication or responsible land-management agency remains the authoritative source.
8. PRIVATE PROPERTY
Unmapped may display property boundaries, public-land boundaries, road classifications, rights-of-way, or related information.
Boundary and ownership information can contain errors and may not reflect recent surveys, transactions, easements, access agreements, or legal determinations.
Unmapped is not a surveying service, title service, legal-access determination, or substitute for official property records.
You are responsible for avoiding trespass and obtaining any required permission.
9. WEATHER INFORMATION
Unmapped may display weather forecasts, radar, precipitation information, temperatures, route-related weather information, and other meteorological data.
Weather can change rapidly.
Weather information may be delayed, incomplete, unavailable, or inaccurate.
Do not rely exclusively on Unmapped for decisions involving severe weather or personal safety.
When conditions may be dangerous, consult official weather authorities and appropriate emergency information.
10. WILDFIRES, HAZARDS, AND EMERGENCY INFORMATION
Unmapped may display information about wildfires, closures, hazards, severe conditions, or emergencies.
Unmapped is not an emergency notification system.
Hazard information may be delayed, incomplete, incorrectly located, outdated, or unavailable.
The absence of a hazard from Unmapped does not mean that an area is safe. Do not rely on Unmapped as your sole source of wildfire warnings, evacuation orders, emergency alerts, severe-weather warnings, or other life-safety information.
Follow instructions issued by emergency services, law enforcement, fire agencies, land-management agencies, weather authorities, and other appropriate officials.
If you are experiencing an emergency, contact the appropriate emergency service where possible.
11. CELLULAR COVERAGE INFORMATION
Unmapped may display modeled or crowdsourced cellular coverage estimates. Users may also opt to record coverage samples locally and separately choose whether to share them, as explained in the Privacy Policy.
Coverage information does not guarantee that cellular service will be available at a particular location or time.
Actual service depends on factors that may include:
- carrier;
- device;
- radio bands;
- terrain;
- vegetation;
- network congestion;
- tower outages;
- weather;
- network changes; and
- other conditions outside Unmapped’s control.
Do not rely on a coverage indication as a guarantee that you will be able to place an emergency call, access the Internet, or contact another person.
12. OFFLINE FUNCTIONALITY
Unmapped allows certain maps and reference data to be downloaded for offline use. A saved map or package does not guarantee offline turn-by-turn routing or rerouting, and some functions require fresh online data. You are responsible for downloading necessary information before entering an area without reliable Internet access.
Offline information may become outdated after it is downloaded.
Road closures, weather, wildfire information, trail conditions, campsite information, community reports, access restrictions, and other dynamic information may change while you are offline.
The fact that information has been downloaded does not guarantee that it remains current.
Some features may require an Internet connection even when other Unmapped functionality is available offline.
13. THIRD-PARTY DATA
Unmapped relies on information from third parties and public sources.
Depending on the feature, sources, infrastructure, or services may include:
- Apple;
- government agencies;
- the United States Geological Survey;
- the United States Forest Service;
- weather agencies and providers;
- wildfire and emergency-data providers;
- Recreation.gov;
- Iowa Environmental Mesonet;
- public-land agencies;
- OpenStreetMap contributors;
- community contributors;
- commercial data providers;
- other geographic or outdoor-information providers;
- Open-Meteo route forecasts;
- Cloudflare infrastructure and website analytics;
- Google Forms for private-beta applications.
Third-party information remains subject to applicable licenses, terms, attribution requirements, availability, and limitations. Unmapped does not control every underlying data source and cannot guarantee the accuracy, completeness, availability, or continued availability of third-party information.
Features may change or disappear if a provider changes its data, license, API, service, or availability.
14. APPLE MAPS, ROUTING, AND OTHER THIRD-PARTY SERVICES
Certain features may use Apple MapKit or other third-party services for maps, search, geocoding, directions, routing, authentication, payments, or other functionality.
Your use of those services may also be subject to the provider’s applicable terms and policies.
Unmapped is not responsible for third-party services outside our control.
15. COMMUNITY REPORTS
Depending on the available app interface, users may submit information such as:
- road closures;
- roadside hazards;
- road conditions;
- trail conditions;
- cellular coverage observations;
- ratings;
- reviews;
- comments;
- other community information;
- user-added campgrounds and corrections to listed places;
- roadside-report confirmations or dismissals;
- optional route-experience and coarse vehicle-capability feedback;
- voluntarily shared, endpoint-trimmed hiking track data.
Community information may be incorrect, misleading, outdated, incomplete, or fraudulent. Unmapped may use bounded submission rules, expiration, human review, aggregation, or corroboration to improve community information. However, a submitted campground is not verified merely because it appears on one device, a proposed correction does not automatically change authoritative data, and no moderation system guarantees that every submission is accurate.
You should evaluate community information together with actual conditions and authoritative sources.
16. YOUR COMMUNITY CONTRIBUTIONS
You are responsible for content you submit through the Services.
You agree not to knowingly submit:
- false hazard reports;
- false road closures;
- intentionally misleading access information;
- fraudulent ratings or reviews;
- unlawful content;
- threats or harassment;
- content that violates another person’s privacy;
- confidential information you are not authorized to disclose;
- malicious code;
- spam;
- content that infringes intellectual-property rights; or
- content intended to interfere with or manipulate the Services.
You should not submit personal or sensitive information in public reviews or community reports.
Unmapped may remove, suppress, expire, moderate, reject, or restrict community content when we reasonably believe doing so is appropriate for safety, reliability, legal compliance, abuse prevention, or operation of the Services.
17. LICENSE FOR CONTENT YOU SUBMIT
You retain any ownership rights you have in content you submit.
By submitting material you intend for other users or for Unmapped's community-data review process, you grant Unmapped a worldwide, non-exclusive, royalty-free license to receive, host, store, reproduce, analyze, technically adapt, aggregate, moderate, display, and distribute that material to the extent reasonably necessary to operate, secure, improve, and provide the requested feature, subject to the Privacy Policy and applicable law.
This license includes the right to:
- display a submitted review;
- include a road report on a map;
- aggregate ratings;
- aggregate cellular coverage observations;
- create community-derived map information;
- summarize community reviews; and
- process submitted content using service providers acting on Unmapped's behalf;
- review an added campground or proposed place correction without automatically publishing it;
- analyze optional route experience and broad vehicle-capability data; and
- review trimmed trail-track observations and use appropriate aggregated or derived trail information.
This license does not authorize Unmapped to sell your personal information in violation of the Privacy Policy.
Where practicable, our use of identifiable submitted content will cease after its removal from active systems, subject to applicable retention disclosures and lawful exceptions. Some submissions have no account association, so Unmapped may be unable to identify or delete every contribution linked to a particular individual on request. An expired report can remain in a database, and a raw trail contribution can be deleted while limited submission metadata remains.
- aggregated or appropriately de-identified information may remain;
- content may remain in backups for a limited period;
- content shared publicly may have been copied by others; and
- legal or security obligations may require limited retention.
18. CELLULAR COVERAGE CONTRIBUTIONS
Coverage recording and sharing are separate options. You may explicitly share locally recorded points or turn on automatic sharing; automatic batches currently require recording to be on, at least 50 queued points, and connectivity. Coverage observations may include geographic and cellular information.
Shared observations include precise location and observation time and can reveal travel patterns even without an account identifier. Enable sharing only if you are comfortable with that risk; already accepted contributions cannot be recalled by switching the control off.
Unmapped may aggregate contributed observations to create or improve cellular coverage information for users.
Your participation is voluntary and may be disabled through available controls.
The Privacy Policy contains additional information concerning the information transmitted and retained.
19. ARTIFICIAL INTELLIGENCE FEATURES
Unmapped's backend can provide Cloudflare Workers AI summaries of recent written trail reviews. Unmapped does not currently provide an AI route planner. Future AI features may require separate terms or disclosures.
AI-generated information may be incomplete, inaccurate, misleading, or inappropriate for current conditions.
Do not treat AI-generated information as authoritative regarding:
- road legality;
- property access;
- trail safety;
- wildfire safety;
- weather safety;
- emergency conditions;
- medical matters;
- vehicle capabilities; or
- other high-risk decisions.
You are responsible for independently evaluating AI-generated recommendations.
AI features may be subject to usage limits, availability restrictions, or additional subscription requirements.
20. TRIPS, JOURNALS, TRACKS, AND USER DATA
Unmapped allows local trips, tracks, notes, favorites, vehicle profiles, journal entries, and photographs. Those private records are not automatically synchronized to an Unmapped user account. You may separately choose to share a trimmed hiking-track contribution or other community content, which is governed by the relevant submission provisions and Privacy Policy.
You are responsible for maintaining appropriate backups of information that is important to you.
Unmapped does not guarantee that locally stored information will never be lost.
Data loss can result from:
- device failure;
- application deletion;
- operating-system behavior;
- corrupted storage;
- software defects;
- user action;
- device replacement; or
- other circumstances.
Do not use Unmapped as the only copy of irreplaceable information.
21. IMPORTS AND EXPORTS
The app may import or export supported GPX data and share notes, routes, or other content using iOS controls. The exact available formats and actions depend on the app version.
You are responsible for ensuring that you have the right to import, export, use, or distribute such information.
Imported data may be inaccurate or malformed.
Exported information may contain location or other information that you consider private.
Review exported information before sharing it.
Once information is shared with another person, application, or service, Unmapped cannot control how the recipient handles it.
22. PHOTOS
Unmapped may allow you to select photographs from your device or associate photographs with locally stored content.
You are responsible for photographs you choose to use or share.
Do not upload, publish, or distribute photographs that violate another person’s privacy, intellectual-property rights, or applicable law.
23. SUBSCRIPTIONS AND PAID FEATURES
Unmapped contains a proposed optional Pro subscription and StoreKit purchase interface. As of the reviewed source state, product identifiers are not configured for release purchases, and the paywall reports that paid subscriptions are not yet available. No payment is needed to access currently available free functionality.
When subscriptions are actually offered, the app will display available products and the price and billing period returned through Apple before a user purchases. Trial, renewal, cancellation, and other material purchase terms must be disclosed in the purchase flow as applicable.
Purchases made through Apple’s App Store are processed by Apple and are subject to Apple’s applicable payment and subscription terms.
Subscriptions may automatically renew unless canceled in accordance with Apple’s applicable procedures.
You are responsible for managing or canceling App Store subscriptions through the mechanisms provided by Apple.
Except where required by applicable law or Apple’s policies, Unmapped does not independently control refunds for transactions processed by Apple.
24. CHANGES TO FREE AND PAID FEATURES
Unmapped is actively developed.
Unmapped may add, modify, replace, discontinue, or reorganize functionality as development continues. Current free-use limits in the app are five saved trips, 500 notes, and one offline region, subject to the applicable counting and storage rules. These are current limits, not a promise that they will never change. We may also change which features are included in free or paid versions of the Services.
However, any such changes remain subject to applicable law, purchase commitments, and other binding promises made to users.
Nothing in this section permits Unmapped to disregard the data-sale and previously collected information commitments contained in the Privacy Policy.
25. FREE SERVICES
Unmapped currently provides basic navigation, hiking, and other functionality without requiring a paid subscription. Pro subscriptions are not currently available for purchase. Offline reference data already on the device may remain available subject to local-storage and licensing constraints if a subscription is offered and later expires.
Free functionality may nevertheless be subject to reasonable limitations involving:
- storage;
- number of downloads;
- server usage;
- rate limits;
- computationally expensive functionality;
- third-party licensed information; or
- other operational constraints.
We do not guarantee that every currently free feature will remain free forever unless we expressly state otherwise.
26. SERVICE AVAILABILITY
We aim to make Unmapped reliable, but we do not guarantee uninterrupted availability.
Services may be unavailable because of:
- maintenance;
- software bugs;
- infrastructure failures;
- Internet outages;
- third-party outages;
- API changes;
- provider restrictions;
- government-data outages;
- excessive demand;
- security incidents;
- natural disasters; or
- circumstances beyond our reasonable control.
Offline functionality may continue to operate in some circumstances, but availability depends on what information has already been downloaded and the feature involved.
27. BETA AND PRE-RELEASE SOFTWARE
Unmapped is currently available through a private TestFlight beta. The Unmapped website also accepts private-beta applications using Google Forms, but applying does not guarantee an invitation or access. Experimental or preview features may change or be withdrawn.
Such features may contain bugs, lose data, behave unpredictably, change substantially, or be discontinued.
You should not rely on beta functionality for critical navigation, emergency planning, or irreplaceable data.
Feedback regarding beta functionality may be used to improve Unmapped.
28. PROHIBITED USE
You may not use the Services to:
- violate applicable law;
- intentionally trespass;
- facilitate theft or property damage;
- harass or threaten another person;
- submit intentionally false safety information;
- manipulate community reports;
- circumvent security or access restrictions;
- interfere with the Services;
- distribute malware;
- fraudulently obtain paid functionality;
- scrape or harvest information in violation of these Terms;
- resell access to the Services without authorization; or
- encourage another person to engage in prohibited conduct.
29. SUSPENSION AND TERMINATION
We may restrict, suspend, or terminate access to online portions of the Services if we reasonably believe a user:
- materially violated these Terms;
- abused community features;
- submitted malicious or fraudulent information;
- attempted to compromise security;
- caused material harm to the Services or other users; or
- must be restricted to comply with law.
Where reasonably appropriate, we may provide notice or an opportunity to correct the issue.
Termination of server access does not necessarily remove local information already stored on your device.
30. INTELLECTUAL PROPERTY
Unmapped and its original software, designs, branding, logos, interfaces, documentation, and other proprietary materials are owned by Unmapped or its licensors and are protected by applicable intellectual-property laws.
Third-party maps, datasets, imagery, trademarks, and other materials remain owned by their respective owners and may be subject to separate licenses.
The Unmapped name, logos, and other branding may not be used in a manner that falsely suggests affiliation, sponsorship, or endorsement. Any rights in submitted content remain subject to Section 17 and applicable law.
31. OPEN DATA AND THIRD-PARTY LICENSES
Some information displayed through Unmapped may originate from open-data or open-source projects.
Those materials remain subject to their applicable licenses and attribution requirements. Nothing in these Terms is intended to limit rights granted directly to you under an applicable open-source or open-data license.
Where required, attribution and licensing information may be provided within the application, website, documentation, or another appropriate location.
32. PRIVACY
Our collection, use, retention, disclosure, and protection of personal information, including optional coverage sharing, raw trail contributions, community submissions, analytics, and beta applications, are described in the Unmapped Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference to the extent permitted by applicable law.
The Privacy Policy includes Unmapped’s commitment not to sell user personal information and provisions intended to preserve that commitment following an acquisition or other change of control.
33. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
UNMAPPED DISCLAIMS WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH DISCLAIMERS ARE PERMITTED BY LAW.
WITHOUT LIMITING THE FOREGOING, UNMAPPED DOES NOT WARRANT THAT:
- THE SERVICES WILL ALWAYS BE AVAILABLE;
- MAPS OR ROUTES WILL BE ACCURATE;
- A ROAD OR TRAIL WILL BE OPEN;
- A ROUTE WILL BE LEGAL OR PASSABLE;
- PROPERTY OR PUBLIC-LAND INFORMATION WILL BE CORRECT;
- WEATHER OR HAZARD INFORMATION WILL BE COMPLETE OR CURRENT;
- COMMUNITY REPORTS WILL BE ACCURATE;
- CELLULAR COVERAGE WILL BE AVAILABLE;
- OFFLINE DATA WILL REMAIN CURRENT;
- AI-GENERATED INFORMATION WILL BE ACCURATE;
- THE SERVICES WILL BE ERROR-FREE; OR
- USER DATA WILL NEVER BE LOST.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.
34. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNMAPPED AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES.
THIS INCLUDES, TO THE EXTENT PERMITTED BY LAW, DAMAGES ARISING FROM:
- RELIANCE ON NAVIGATION INFORMATION;
- ROUTE OR MAP ERRORS;
- ROAD OR TRAIL CONDITIONS;
- PROPERTY OR ACCESS INFORMATION;
- WEATHER OR WILDFIRE INFORMATION;
- COMMUNITY REPORTS;
- LOSS OF CELLULAR SERVICE;
- DATA LOSS;
- SERVICE INTERRUPTION;
- VEHICLE DAMAGE;
- LOST PROFITS;
- LOST OPPORTUNITIES; OR
- LOSS OF DATA.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UNMAPPED'S TOTAL AGGREGATE LIABILITY TO YOU FOR CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US$100 OR (B) THE AMOUNT YOU PAID TO OBTAIN OR USE THE SERVICES IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THIS LIMITATION DOES NOT APPLY WHERE THE LAW PROHIBITS IT.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
35. ASSUMPTION OF RISK
You understand that driving, off-roading, hiking, camping, and remote travel involve risks that cannot be eliminated by navigation software.
To the extent permitted by applicable law, you accept responsibility for evaluating those risks and deciding whether to proceed with an activity.
Nothing displayed by Unmapped constitutes a guarantee that an activity, route, location, or condition is safe.
36. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Unmapped and its owners, officers, employees, contractors, and agents from third-party claims arising from:
- content you unlawfully submit;
- your intentional misuse of the Services;
- your infringement of another person’s rights; or
- your material violation of these Terms.
This obligation does not require you to indemnify Unmapped for conduct for which indemnification cannot lawfully be required.
37. GOVERNING LAW
These Terms will be governed by the laws of the State of Arkansas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
38. DISPUTE RESOLUTION
If you have a dispute concerning the Services, please contact Unmapped using the information below so we can attempt to resolve the issue informally. These Terms do not require arbitration or prevent either party from seeking relief in a court with jurisdiction, subject to applicable law.
39. CHANGES TO THESE TERMS
We may update these Terms as the Services evolve. If a change is material, we will provide notice where appropriate or required by law.
Changes will apply prospectively from their applicable effective date except where applicable law permits otherwise.
A modification of these Terms does not, by itself, eliminate privacy protections applicable to information previously collected under the Unmapped Privacy Policy.
40. TRANSFER OF UNMAPPED
Unmapped may be involved in a merger, acquisition, restructuring, financing, asset sale, or similar transaction.
A successor may assume these Terms as part of continuing the Services.
Any transfer of personal information remains subject to the commitments contained in the Privacy Policy, including applicable restrictions on the sale of user personal information.
Nothing in these Terms grants a purchaser an unrestricted right to commercially exploit user personal information.
41. ASSIGNMENT
You may not transfer your rights under these Terms without our consent except where applicable law provides otherwise.
Unmapped may assign these Terms in connection with a legitimate merger, acquisition, reorganization, sale of substantially all operating assets, or similar transaction, provided that applicable obligations concerning user information remain subject to the Privacy Policy and applicable law.
42. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the maximum extent permitted by law.
The invalid provision will be interpreted or modified to the minimum extent necessary to make it enforceable where permitted.
43. NO WAIVER
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
44. ENTIRE AGREEMENT
These Terms, the Privacy Policy, applicable purchase terms, and any additional terms expressly presented for a particular feature constitute the agreement between you and Unmapped regarding the Services, subject to applicable law.
Third-party services may be governed by additional agreements between you and those providers.
45. APPLE APP STORE LICENSE
For the iOS app, Unmapped currently uses Apple's Standard End User License Agreement rather than a custom App Store license. The standard license governs installation and use of the app when distributed through the App Store. Its terms are available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
These Unmapped Terms separately apply to use of the Services, community contributions, content, and related matters to the extent consistent with Apple's Standard End User License Agreement and applicable law. If the two agreements conflict concerning the app license, the applicable Apple standard license controls.
